Notice periods: distinguish time worked from payment in lieu
The difference between working a notice period and paying in lieu, and what to check before using the general 7, 14 or 28-day scale.
Notice pay is not another name for severance. In the general regime, article 76 addresses advance notice of desahucio; article 79 covers compensation when notice is omitted or insufficient.
Dates are part of the calculation
Article 76 uses 7, 14 and 28 days according to continuous service. Its exact boundaries matter; rounding service to the nearest year is not enough.
Record the notification date, last working day and whether notice will be worked. Article 78 keeps contractual duties in place during notice. If notice is fulfilled, do not automatically record it again as payment in lieu.
Check the regime before using the table
A general calculator does not automatically determine the rights arising from domestic work. Review articles 258–265 and the actual arrangement for household staff. Do not call an employer’s decision a resignation.
Retain the communication
Keep a dated copy and the breakdown of any payment. In the general regime, article 77 addresses communication to the worker and the labour authority. Formalities and deadlines are not fulfilled merely by checking a box in an application. A clear record shows what was communicated and when, rather than relying on memory later.
