Ending employment: prepare instead of improvising
The facts, documents and conversations to organise before ending an employment relationship with household staff and closing the records.
Ending employment involves more than removing someone from a staff list. Before changing access or closing payments, establish what happened, which regime applies and what remains outstanding.
Describe the situation correctly
Desahucio, dismissal and dimisión have distinct meanings in the Labour Code. Do not choose whichever label produces the lowest calculator result. The actual activity, reason and evidence matter; domestic work also requires considering articles 258–265.
Gather outstanding items
Prepare dates, agreements, salary records, leave, holidays and Christmas-salary receipts. Identify advances or loans without automatically treating them as deductions whose validity has not been checked. Separate household property from the worker’s personal documents.
Do not handle protected circumstances with a button
Pregnancy, illness, a complaint or a disputed reason may require examination before action. Protection rules and procedures cannot be replaced by an automatic calculation.
Close with clear records
Document communications and agreed or applicable payments. Provide receipt copies and arrange the return of keys and access without retaining personal documents. Then update staff status while retaining the appropriate history.
The purpose of this checklist is to organise information. It does not determine the lawful reason for a particular termination or turn an unverified deduction into an authorised one.
